The Allahabad High Court on Friday directed the CBI to arrest BJP MLA Kuldeep Singh Sengar in connection with the alleged rape of a 17-year-old girl in Uttar Pradesh's Unnao district.

After running from pillar to post for justice, an FIR finally came to be recorded Sections 363, 366, 376, 506 IPC and 3/4 of the POCSO Act against Sengar on April 12 this year. Subsequently, her father died in jail with post-mortem suggesting serious injuries on his body. "The approach of the learned Advocate General is not only appalling but shocks the conscience of the Court in the backdrop of the instant case", said the bench in its Friday order.

The agency which was referred the matter only yesterday took immediate action by re-registering the UP police FIRs and brought the four-time MLA to its Lucknow office at around 5 am for questioning, they said.

On April 11, the prime accused in the matter, BJP MLA Kuldeep Singh Sengar was seen roaming outside the residence of SSP in Lucknow.

Though Sengar has been claiming innocence, the state government came under fire for not acting against the politician in spite of repeated accusations.

The counsel for the state government informed the court that the case has been handed over to the probe agency, which detained Sengar but has not arrested him yet.

The Allahabad High Court on Thursday said that it would pronounce its order on the Unnao rape case at 2 pm on Friday, news agency ANI reported. He was beaten mercilessly in custody as well and it further appeared from the submissions made in the court that false cases were lodged against the family members of the victim.

Other cases pending against Kuldeep Singh Sengar are Section 171 IPC (Wearing garb or carrying token used by public servant with fraudulent intent), Section 188 IPC (Disobedience to order duly promulgated by public servant), Section 353 IPC ( Assault or criminal force to deter public servant from discharge of his duty) and many more.

When asked when Sengar would be arrested, Principal Secretary (Home) Arvind Kumar told reporters here that the CBI would take a decision on this.

The Uttar Pradesh Police on Wednesday filed a first information report against Sengar, charging him under the Protection of Children from Sexual Offences Act.

According to a report in NDTV the accused has been taken in for questioning by the Central Bureau of Investigation (CBI) at 4 am today.

Chaturvedi also demanded fair investigation in the heinous crime and later, on the death of the victim's father. The bench of Chief Justice Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud said it would hear the plea which has also alleged that the rape victim's father was tortured and killed in the police custody at the behest of the "ruling party" in the state.
